Terms and Conditions

Introduction

These Terms and Conditions (“Terms”) govern the relationship between you (“the Client”) and 529ers (“the Company”, “we”, “us”, or “our”), a web design and development company based in the United Kingdom. By engaging our services, you agree to be bound by these Terms.

Services

We offer web design and development services, including but not limited to website creation, website redesign, e-commerce solutions, and website maintenance. The specific services provided will be outlined in a written agreement between the Client and the Company.

Quotes and Pricing

All quotes provided by the Company are valid for 30 days from the date of issue. The final price for the project will be determined by the scope of work agreed upon by both parties in the written agreement. Additional work requested by the Client outside the agreed-upon scope may result in extra charges.

Payment Terms

The Company offers a unique demo process, allowing the Client to preview the website design before making any payment. Upon the Client’s satisfaction with the demo, an invoice will be issued. Payment terms will be specified in the written agreement, and typically include a deposit, progress payments, and a final payment upon project completion.

Project Timeline and Delays

The Company will endeavour to complete the project within the agreed-upon timeline. However, the Client acknowledges that delays may occur due to unforeseen circumstances, changes in scope, or the Client’s failure to provide necessary materials or feedback in a timely manner. The Company shall not be held responsible for such delays.

Client Responsibilities

The Client is responsible for providing all necessary materials, including logos, images, and written content, in a timely manner. The Client must also provide prompt feedback and approvals when requested. Failure to do so may result in project delays or additional charges.

Intellectual Property Rights

Upon full payment of the project, the Client will be granted a non-exclusive, non-transferable license to use the website design and its associated materials. The Company retains ownership of all intellectual property rights related to the design, including but not limited to, copyrights, trademarks, and trade secrets.

Third-Party Services

The Client may be required to engage third-party services for domain registration, hosting, or other services. The Company is not responsible for any issues, fees, or disputes arising from the use of third-party services.

Limitation of Liability

In no event shall the Company be liable for any indirect, special, incidental, or consequential damages arising out of or in connection with the services provided, including loss of profits, loss of data, or business interruption.

Termination

Either party may terminate the agreement upon written notice if the other party breaches any material term or condition of these Terms and fails to remedy the breach within 30 days of receiving notice.

Governing Law

These Terms and Conditions shall be governed by and construed in accordance with the laws of the United Kingdom. Any disputes arising out of or in connection with these Terms shall be subject to the exclusive jurisdiction of the courts of the United Kingdom.

Changes to Terms

The Company reserves the right to amend these Terms and Conditions at any time. Any changes will be posted on our website, and it is the Client’s responsibility to review the updated Terms.
